Terms of Service

By accessing or using Namaste Buddy (“Service”, “we”, “us”), you agree to be bound by these Terms of Service (“Terms”). If you are accessing the Service on behalf of a child under 18, you represent that you are their parent or legal guardian and that you accept these Terms on their behalf.

The Service is operated by Proscale Technologies Pvt Ltd (trading as Namaste Buddy). These Terms are governed by the laws of New South Wales, Australia.

Namaste Buddy is designed for children aged 5–15. All accounts for children under 13 must be created and managed by a parent or legal guardian. By creating an account, you confirm that:

• You are at least 18 years old (or the parent/guardian of the child using the Service);
• All information you provide is accurate and complete; and
• You will keep your login credentials confidential.

We offer the following subscription plans, all prices in Australian Dollars (AUD) and GST-inclusive:

• Free: Limited access to 2 roleplay scenarios and daily journal, no charge.
• Monthly: $14.99 AUD/month, billed monthly, cancel anytime.
• Annual: $129.00 AUD/year (equivalent to $10.75/month), billed once annually.

Subscriptions automatically renew unless cancelled before the renewal date. You can cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will not be charged for the next cycle.

Payments are processed by Paddle.com Market Limited (“Paddle”), who act as our authorised reseller and merchant of record. Your payment details are stored securely by Paddle and are never held on our servers.

We may offer a 14-day free trial for new premium subscribers. After the trial period, your selected plan will begin billing automatically. We will notify you by email before your trial ends. You may cancel during the trial without charge.

We want Namaste Buddy to feel risk-free. That's why we offer a 14-day free trial — no charge until you're sure, and one-click cancel from your account before then. For most families, that's all that's needed.

For everything else, here's how we think about refunds:

Faulty service.If Namaste Buddy isn't working as described or has a major issue, you're protected by the Australian Consumer Law and we'll make it right — refund included if that's the appropriate remedy.

Forgot to cancel.Life happens. If your trial converted to paid and you didn't end up using the service, email us within 7 days of the charge and we'll work something out.

Annual renewal.If your annual plan auto-renews and you'd rather stop, email us within 7 days of the renewal charge for a pro-rated refund of the unused time.

The fastest way to reach us is support@namastebuddy.com — a real human reads every message and usually replies within one business day.

One small note: cancelling your subscription stops future charges but doesn't automatically refund past ones. Just mention it in your email if you'd like both. All approved refunds are processed by Paddle, our payment processor, back to your original card.

Namaste Buddy is designed around healthy weekly practice. Each user account is entitled to up to 35 minutes of active chat engagement per calendar week (Monday 00:00 UTC to the following Sunday 23:59 UTC). This limit applies to all paid and free tiers, reflects research that short, regular sessions produce better language-learning outcomes than long marathons, and aligns with Australian eSafety Commissioner guidance for children's screen time.

Engagement time is measured server-side based on active chat activity (paused when the app is in the background) and is clamped to a sane per-turn range so neither rapid spamming nor idle tabs affect the cap. When the weekly limit is reached, the chat will display a friendly “weekly practice complete” message and resume the following Monday.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorised access to any part of the Service;
• Reverse-engineer, decompile, or disassemble any part of the Service;
• Use automated scripts to scrape or interact with the Service; or
• Transmit harmful, offensive, or inappropriate content.

Namaste Buddy uses artificial intelligence (powered by Anthropic's Claude) to generate conversational responses. While we take care to make responses age-appropriate and educationally sound, AI outputs may occasionally be imperfect. We do not warrant that AI-generated content is always accurate, complete, or suitable for every learner. Parents are encouraged to participate in their child's learning sessions.

All content, trademarks, and software associated with Namaste Buddy are the property of Namaste Buddy Pty Ltd or our licensors. You may not reproduce, distribute, or create derivative works without our express written permission.

Content you input into the Service (such as voice recordings or journal entries) remains yours. You grant us a limited licence to process that content solely to provide the Service.

The Service is provided on an “as is” basis. To the maximum extent permitted by Australian law, we disclaim all warranties, express or implied. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under the Australian Consumer Law.

We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales. If a dispute cannot be resolved through negotiation, either party may refer it to mediation before commencing court proceedings.
